Legal Theory

Questia, your online research library and paper writing resource, contains thousands of scholarly articles and books about Legal Theory.

Legal theory, or jurisprudence, is the study of everything encompassing the philosophical body of law. As there is no succinct definition to jurisprudence due to varying circumstances or methods, legal theorists can agree that it seeks to understand and or criticize the foundations in which law was based on. These jurisprudential questions take in consideration that the proposed laws are inherent, consistent, and adaptable into the practice of law. Legal theory has no implication that law is assumed, but rather that limitations are sought within the legal system for the well-being of society.
